What are your legal rights as a Brooklyn tenant?

Finding a place to call home in Brooklyn means knowing your tenant rights from day one. These rights protect you and help you deal with landlord issues before they become big problems.  

Basic rights every Brooklyn tenant has  

New York law gives Brooklyn tenants solid legal protection. Your home must be safe and livable, with working heat, hot water and proper building upkeep. Landlords must write to you before they raise your rent or end your lease. They must also return your security deposit within 14 days of moving out.  

Must-know protections for Brooklyn renters  

Your landlord can’t turn you down because of your race, religion, nation of origin, gender, disability, sexual orientation or how you pay your rent. If you have a disability, you can ask for changes to your apartment, and your landlord must make them unless it’s too costly.  

You deserve privacy in your home. Your landlord must tell you at least 24 hours before coming to your apartment unless there’s an emergency. When something breaks, they must fix it fast – especially if it’s heat or hot water, which they must resolve within 24 hours.  

You can also join or start tenant groups with your neighbors. Your landlord can’t punish you for being part of these groups. If your landlord breaks any rules, you can report them to the New York State Division of Housing and Community Renewal.
